Report submitted by the learned advocate appearing for the State be kept with the record. Records of the writ petition reflect that pursuant to the issues relating to non-payment, information was furnished with the Officer-inCharge, Shyampukur Police Station, but no steps were taken.

State has submitted a report which reflects that petitioner failed to produce any bills or challans in respect of rice/materials supplied to the respondent no.5.

On the other hand, respondent no.5 reported to the police authorities that he had handed over three cheques.

Having considered that there was a contractual obligation and no issue relating to deception having been canvassed, I am of the opinion that since substantial time has passed, in the circumstances petitioner would better approach the jurisdictional Magistrate under relevant provisions of law. In case learned Magistrate after assessment and ascertaining the circumstances is

of the opinion that any offence is made out, he would pass necessary orders as he deems fit and proper.

With the aforesaid observations, the writ petition being WPA 15735 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
