1. Learned counsel appearing on behalf of the petitioner submits that the only material available against the petitioner is the statement of a co-accused, which is inadmissible in evidence. Two other co-accused have been granted anticipatory bail earlier.
2. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. However, she submits that other than the statement of the co-accused there is hardly anything appearing against the petitioner.
Charge-sheet has been submitted.
3. Considering the materials available in the case diary and the fact that other than the statement of co-accused there is hardly anything appearing against the petitioner in the case diary and the fact that two other co-accused have
been granted anticipatory bail in this case, I am inclined to grant the anticipatory bail to the present petitioner.
4. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and the petitioner shall not threaten or intimidate witnesses. The petitioner shall appear before the jurisdictional Court and pray for bail within four weeks from date and shall regularly attend the jurisdictional Court.
5. Accordingly, the application for anticipatory bail is allowed.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
