No one represents respondent no.6.

It is the allegation of the petitioner that respondent no.6 has raised an unauthorised construction at Holding No.98, Ward No.12, Krishnanagar, Nadia. He claims to be the owner of the adjacent premises.

Learned advocate representing the Municipality submits that the Municipality had issued a "stop work" notice on April 12, 2024, regarding the unauthorised construction. He further submits that the Municipality

also called for a hearing of the concerned parties on May 10, 2024.

In view of the aforesaid facts, I dispose of the writ petition with a direction upon the Municipality to initiate appropriate proceedings following the "stop work" notice dated April 12, 2024 in accordance with law and conclude the same within a period of two months thereafter.

Needless to mention that all concerned parties should be heard by the Municipality in arriving at the decision.

The Municipality shall also ensure that no further unauthorised construction takes place in the premises in question.

Accordingly, WPA 15698 of 2024 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
