Mr. Debasish Ghosh Mr. Nilanjan Adhikari.........for petitioner Mr. Prosenjit De.............for KMC Petitioner has come to Court with grievance that in premises adjacent being 22C, Ganga Prasad Mukherjee Road, Kolkata-700025, pucca roof is being constructed by private respondent.

Mr. Ghosh, learned advocate appears on behalf of petitioner and submits, his client complained to the Corporation but unless there is direction from Court, the Corporation will not act. Mr. De, learned advocate appears on behalf of the Corporation and submits, direction made by Court will be complied.

Private respondent goes unrepresented.

Affidavit of service filed shows postal service could not be made on endorsement, 'item on hold, addressee absent'. Court is satisfied with the service. The Corporation will cause inspection of the premises, to ascertain whether construction of pucca

roof is being made. In event such is not under a sanctioned plan, Corporation will take steps in accordance with law to stop construction and follow through with initiation of demolition proceedings. Inspection must be made within two weeks of communication of this order. Follow through action four weeks thereafter. In event the Corporation finds no cause for demolition, the reason for it must be made known to petitioner on serving a copy of order in demolition proceeding upon petitioner.

The writ petition is disposed of.
