The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with. The petitioners are the defendants in a suit for partition being Title Suit No. 170 of 2016, which is pending before the Court of the learned Civil Judge, (Senior Division) at Sealdah, District - 24 Parganas (South).

It appears from the record that the suit is at the peremptory hearing stage, therefore the learned Trial Judge is requested to make all endeavour to dispose it of as expeditiously as possible in accordance with law and in doing so, shall not grant any unnecessary adjournment to either of the parties.

C.O. 2129 of 2024 is disposed of with the above terms without any order as to costs.
