Mr. Madhusudan Sur Mr. Dipankar Paramanick .....For the State The present revisional application was preferred challenging the proceedings arising out of Nabadwip Police Station Case No.343 of 2015 dated 28.08.2015 and the order dated 01.02.2019 passed by the Learned Magistrate, Nabadwip, Nadia. The order dated 22.06.2017 reflects that the learned Court was pleased to frame the charges and directed for issuance of summons against CSW-1 and CSW2. The order dated 01.02.2019 reflects that no witness turned up before the Court and, as such, Learned Court was pleased to direct that the summons be issued upon the said charge-sheeted witnesses again and fixed date for evidence.

Having considered the order passed on 1st February, 2019, I am of the opinion that no interference is called for at this stage. Secondly, so far as the merits of the case are concerned, having regard to the advanced stage of the case, I am of the view that this Court at this belated stage cannot interfere with the merits of the proceedings.

As none appears on behalf of the State, Mr. Madhusudan Sur, learned advocate who ordinarily represents on behalf of the State is directed to represent the case on behalf of the State. His appointment may be regularized by the concerned authority. In view of the observations made above, CRR 2008 of 2021 is disposed of.
