The petitioner is aggrieved by the fact that in spite of ad interim injunction order being passed by the learned civil court, the police authorities are not adhering to the directions passed in O.C. Suit No.04/2020.

State has submitted a report which reflects that as and when information has been furnished, police authorities have taken steps. Accordingly, three FIRs have been registered as well as proceeding under Section 107 of the Code of Criminal Procedure has been drawn up. The police authorities have concluded the investigation of the respective cases. However, the police authorities claim that a proper copy of the injunction order was never served upon them.

In case the police authorities are furnished with a proper order of the civil court, the police

authorities would respect and obey such order. However, the petitioner would take out appropriate application before the civil court for rendering police assistance. In case such a direction is passed by the civil court, the police authorities would then implement the order concerned.

With the aforesaid observations, the writ petition being WPA 14744 of 2023 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
