The petitioner's complaint before the police authorities were diarized vide Cyber Crime Police Station Howrah Police Commissionerate GDE No. 266 dated May 27, 2022. On several occasions the police tried to contact the petitioner. The petitioner did not receive the calls made by the Inspector-incharge, Cyber Crime Police Station. Another GDE No. 153 dated July 15, 2022 was registered. The ASI went to Belgachia, Lichu Bagan, Liluah to trace out the petitioner, but the petitioner could not be located. Messages were sent to the Officer-in-charge, Lilua Police Station and Officer-in-charge, Hasnabad Police Station on July 18, 2022 with a request to inform the petitioner to appear before the Cyber Crime Police Station, Howrah Police Commissionerate, for the purpose of enquiry.

On August 3, 2022, the petitioner went to the police station. He was interrogated. He was asked to produce photographs and the link through which such posts were made. The petitioner could not supply any proof. Instead, the petitioner submitted that he had heard that a picture of the petitioner and a lady had been circulated by the alleged Biru Sahany. Biru Sahany was contacted by the Golabari Police Station. The matter was diarized, but the enquiry did not reveal any evidence of any photograph of the petitioner having been uploaded in any digital platform or the social media.

Under such circumstances, nothing remains to be decided in the writ petition.

If in future, the petitioner is able to produce evidence before the police authorities, then the police authorities shall take necessary steps as they may deem fit and proper, strictly in accordance with law. This order shall not be construed as an acceptance of the allegations made by the petitioner against the respondent no. 5.

The writ petition is accordingly disposed of. There shall be no order as to costs.
