The application being CRAN 1 of 2023 is taken up by treating the same as on day's list.

Pursuant to the earlier order so passed, the State has submitted a report through the Officer-in-Charge, Park Street Police Station. The report is enclosed with a communication made to the Officer-in-Charge, Park Street Police Station and a statement recorded by a Sub-Inspector of Police associated with Park Street Police Station. The communication so received reflects that the complainant viz. Atika Jatin Obhan is not interested to pursue the criminal case being Park Street Police Station Case No. 76 of 2021 dated 03.06.2021 under Sections 498A/323/34 of the Indian Penal Code pending before learned Chief Metropolitan Magistrate,

Calcutta. The complainant has also informed that there has been settlement with her husband along with her in-laws. Considering the report which has been sent, the communication which has been made by the complainant to the Officer-in-Charge, Park Street Police Station and the statement recorded by the officer of Park Street Police Station, I am of the view that as the proceedings arose out of matrimonial discord/dispute, further continuance of the proceedings is unwarranted.

Accordingly, all further proceedings arising out of Park Street Police Station Case No. 76 of 2021 dated 03.06.2021 under Sections 498A/323/34 of the Indian Penal Code are hereby quashed.

Accordingly, the revisional application being CRR 1967 of 2021 along with CRAN 1 of 2023 is allowed. Other pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
