The petitioner is aggrieved by the order passed by the Sub-Divisional Officer, Contai on May 30, 2022 under Section 10(3) of the West Bengal Highways Act, 1964 (hereinafter referred to as "the Act of 1964"). The said order is appealable under Section 10(4) of the Act of 1964. In view of the same the writ petition being WPA No. 15027 of 2022 is dismissed as not maintainable. However, the petitioner is granted liberty to approach the appropriate forum for redressal of his grievance.

In the event the petitioner prefers the appeal within 15 days from date, the appellate forum shall deal with the appeal on merits without dismissing the same on the ground of limitation.

There shall be no order as to costs.
