Since the innocuous prayer of the petitioner is for expeditious disposal of G.R. case no. 2793 of 2012 arising out of Titagarh Police Station case no. 381 of 2012 dated 24th June, 2012 pending before the learned Judicial Magistrate, 1st Court, Barrackpore, the matter may be disposed of without service of notice upon the opposite party. The opposite party shall not be prejudiced if the matter is disposed of by the learned trial Court expeditiously. It is submitted by the learned counsel for the petitioner that out of nine witnesses, three witnesses have been examined. 2793 of 2012 pending before him within one year from the next date of hearing fixed before him without granting any unnecessary adjournment to either of the parties, in accordance with law.
