Learned advocate for the petitioner submits that the petitioner is the father in law of the victim. He submits that the husband of the victim is in custody. He contends that the victim committed suicide.
Learned advocate for the State opposes the prayer for bail and draws attention of this Court to the post mortem report and the statement recorded under section 161 Cr.P.C. Having considered materials on record and bearing in mind the extent of complicity of the petitioner in the alleged crime and the fact that the petitioner and the husband of the victim are not on the same footing, we are inclined to grant bail to the petitioner. Accordingly, the petitioner be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned CJM, Nadia at Krishnagar on condition that the petitioner shall appear before the trial court on every date of hearing until further
orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever and on further condition that the petitioner shall meet the investigating officer once in a fortnight until further orders.
In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court. The application being CRM 6419 of 2021 is disposed of. (Ananda Kumar Mukherjee, J.) (Debangsu Basak, J.)
