Leave is granted to the learned advocate on record for the petitioner to add the DPSC, Howrah as party respondent to the instant proceeding.

Learned advocate on record of the petitioner shall amend the cause title in course of the day.

The petitioner seeks transfer from Howrah to Murshidabad on account of the medical condition of her daughter. The daughter is stated to be suffering from a cardiac ailment.

In the above circumstances, the DPSC, Howrah shall obtain the medical opinion of the condition of the petitioner's daughter from the CMOH, Howrah and forward the same along with his comments to the Secretary, West Bengal Board of Primary Education.

Upon receipt of such medical opinion and, if satisfied, the Secretary, West Bengal Board of Primary Education shall pass necessary orders in accordance with the rules within a period of 12 weeks from the date of communication of a copy of this order along with a copy of this writ petition.

If there is need for ascertaining the confirmation of the service of the petitioner, the same may be obtained from the concerned DPSCs and/or DIs by the WBBPE. 7.

With the aforesaid direction, the writ petition is disposed of.

There shall be no order as to costs.

9.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Rajasekhar Mantha, J.)
