Mr. Majumder, learned counsel appearing on behalf of the petitioner submits that an appeal has been preferred from the final order of removal from service dated November 9, 2021 before the appropriate appellate authority. The petitioner who was working as Head Constable in the Railway Protection Force (in short, "RPF") was removed from service by the said order of the disciplinary authority. On December 8, 2022 when the matter came up for consideration, it was submitted by Mr. Bipul Kumar Mondal that no appeal had been preferred till date.

Today, it is submitted that a copy of the appeal has been received by the authorities yesterday.

In the circumstances, it is submitted by Mr. Majumder that the appeal be disposed of on merits by a reasoned order

within three months from the date of communication of this order by the appropriate authority.

Such prayer is considered and allowed.

With the directions aforesaid, W.P.A. 15701 of 2021 is disposed of.

Since no affidavits have been directed to be exchanged in the present writ petition, the allegations contained in the writ petition are deemed not to have been admitted by the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all the formalities.
