In all these matters learned Counsels appearing for the respective parties uniformly submitted that the pivotal issue involved herein relates to vires of Section 10(C) of the West Bengal School Service Commission Act, 1997.
All the matters were directed to appear together so that by a common judgement the same can be disposed of.
Learned Advocate General submits that the affidavit-in-opposition in WPA 15707 of 2021 is ready and can be filed by tomorrow.
However, the learned Counsels appearing for the respective writ petitioners say that apart from the point agitated in the aforementioned case the additional points have also been taken leading to the challenge relating to vires of the said provision of law and the State has not used the affidavit as yet. In order to avoid any complication or point of demurrer being taken, we intend the affidavits to be completed in all such matters so that the points, which have been taken by the respective parties, can be conveniently dealt with by the State in the affidavit-in-opposition.
Accordingly, the State is directed to file affidavitin-opposition by Thursday (18.11.2021);
copy whereof shall be served upon the appearing Counsels on or before 18th November, 2021. Reply, if any, shall be filed by Monday (22.11.2021).
The matters are made returnable on 23rd November, 2021.
We are, however, informed that some other matters pertaining to the same issue have not been listed today.
Learned Advocate appearing for the School Service Commission hand over the list of such matters. Let such matters appear also along with the aforementioned cases on the returnable date.
