An order no. 15 dated 21st May 2024 passed by the learned Additional District Judge, 16th Court, Alipore in Act VIII Case No. 129 of 2023 is challenged in the instant revisional application.
By the said impugned order, the visitation of the parties with the child was permitted by the Court and taking into account certain events happened in past, the liberty was granted to the parties to ensure the presence of their respective junior Advocates during the said visitation.
In the earlier order dated 14th May 2024, the Trial Court noticed certain untoward incident happened at the place of visitation and requested both the learned Advocates so that the visitation remain seamless in presence of the respective junior Advocates.
Obviously, the Court must have seen certain events happened and in order to stop the recurrence thereof was of the opinion that it would ensure the visitation should happen with the child. It may also help the Court to assess the situation as the interest of the child is of paramount consideration.
Though it has been submitted by the learned
Advocate for the husband/petitioner that the wife/opposite party is not complying any such direction, but after hearing the learned Advocate for the wife/opposite party that there is no obstacle created by her in visitation of the husband/petitioner to meet the child, I do not think any further observations is required to be made in this regard.
The parties are requested to maintain a congenial atmosphere at the time of visitation in terms of the order passed by the Court below.
In view of the above, the revisional application and the connected applications are disposed of.
There shall, however, be no order as to costs. (Harish Tandon, J.)
