The instant appeal is preferred challenging the impugned order dated 26.2.2007 passed by the learned Trial Court, in connection with Criminal Misc. Case no. 249 of 2007. By passing the impugned order the prayer of the petitioner filed under Section 340 of the Code of Criminal Procedure, was turned down.

Being aggrieved and dissatisfied with the said impugned order the present Appeal is preferred at the behest of the present appellant. 6.

It is submitted by the learned Advocate for the appellant that the present appellant does not intend to proceed further with the present appellant. 7.

I have gone through the impugned order passed by the learned Trial Court dated 26.2.2007, and I find nothing material to interfere with the said impugned order.

Accordingly, the instant appeal being CRA 346 of 2007 be and the same is dismissed, affirming the impugned order passed by the Trial Court on 26.2.2007.

Department is directed to send down the Trial Court Record immediately.

10. As such the present appeal is disposed of.
