Learned advocate for the petitioner is innocent of the charges and has been falsely implicated in connection with the instant case. Learned advocate for the petitioner submits that already the stage of Section 251 of the Code of Criminal Procedure is over. However, the trial of the case is not progressing smoothly and the present petitioner being innocent and an accused has to face the hassles of a criminal trial. Records of this revisional application reflect that the case was initiated in the year 2019 and more than four years have passed since then.
The learned trial court is directed to fix at least one date in every sixty days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. Needless to state that the petitioner has been able to make out a factual defence but the same is to be tested on the anvil of cross-examination of the complainant and by way of defence witness in course of the trial.
Petitioner be given every opportunity to produce his evidence and rebut the prosecution case.
With the aforesaid observations, the present revisional application being CRR 2300 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
