A report has been submitted by the learned advocate for the State, the same be kept with the record. The report reflects that the absconding accused Shyamal Chandra Sarkar was arrested and was produced before the learned District and Sessions Judge, 6th Court, Barasat.

The trial court has been pleased to fix date on 6th September, 2023 for consideration of charges. The present petitioner is in custody since 14.12.2021. Having regard to the fact that the petitioner is in custody for about 19 months, I direct that the trial court would fix a schedule consisting of 3 dates after the consideration of charges are over on 6th September, 2023 or within a fortnight thereafter and proceed with the trial by fixing a schedule once in every 60 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

No unnecessary adjournment should be granted to the parties.

The learned trial court would communicate with the superintendent of police of concerned district for ensuring presence of the concerned witnesses.

Public Prosecutor conducting the case would make available all the necessary documents, statements, materials and exhibits on the date fixed for examination of the witnesses. All stakeholders must cooperate with the court to complete the trial within a reasonable period of time.

With the aforesaid observations, CRR 2302 of 2023 is disposed of.

Pending application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of such requisite formalities.
