Learned Advocate appearing for the petitioner submits that on December 10, 2021, the bail was granted to the petitioner on the condition that the petitioner furnish a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Baruipur, South 24 Parganas. He submits that the jurisdictional Court is insisting upon the title deeds in respect of the local surety. The petitioner is unable to find a local surety with a tittle deed in respect of a land. He therefore, seeks relaxation of such condition. The State is represented.

In our understanding, a local surety need not be a person with landed property in the locality. However, since the petitioner was granted bail on December 10, 2021, it would be appropriate to modify the condition requiring local sureties to be that of the two sureties who will be registered sureties.

CRAN 3 of 2022 is disposed of accordingly.
