January 11, 2022 Sl. No.25 Court No.1 SG/s.biswas WPA 14079 of 2018 Bankim Sarkar vs.

The State of West Bengal and others (Through Video Conference) No one is present for the petitioner. The writ petition is pending since 2018.

Record perused.

The petitioner claiming himself to be a social spirited person has raised the grievance that the official respondents are constructing road from Sagardighi Bridge to Dinhata through the contractor by taking forcible possession of the land of the villagers. In the writ petition certain facts relating to title and possession of private individuals have been mentioned without filing any supporting documents. If the individual villagers have any grievance in respect of the construction of road on their land then they can very well approach the competent authority. That apart, after filing the petition the petitioner has not come forward to prosecute it. We do not find any reason to keep the petition pending. Hence, the petition is dismissed. If the individual villagers are affected by the alleged construction of road, they will be at liberty to approach the competent authority in accordance with law.
