This revisional application has been filed with a prayer for quashing of the proceedings of New Market Police Station Case No. 274 of 2013 dated 19.06.2013 corresponding to G.R. No. 2353 of 2013 under Sections 11J/11L of the West Bengal Fire Services Act, 1950, pending before the Court of learned Chief Metropolitan Magistrate at Calcutta.

Brief facts of the case is that the building being premises No. 71/C, Nellie Sengupta Sarani, which was constructed sometime in 1930, since then the premises was under full occupation of tenants and the property is a trust property and the petitioner is a managing trustee. The case was initiated by a written complaint addressed to the Officer-in-Charge of New Market Police Station alleging, inter alia, that in the said building there was no fire safety measures according to

recommendation of the Fire Services Department in view Section 11C of the West Bengal Fire Services Act, 1950. Accordingly, the complaint was registered and investigation was started and chargesheet ultimately submitted against the petitioner being managing trustee of the building.

Mr. Ayan Bhattacherjee, learned advocate appearing on behalf of the petitioner has submitted that the petitioner being the managing trustee is not liable to take any safety measures as he already informed the tenants of the building to take all the safety measures according to recommendation.

Mr. Bhattachaerjee, learned advocate appearing on behalf of the petitioner inclines to withdraw this revisional application with a prayer for giving liberty to raise all the issues at the time of consideration of charge. Liberty is given to the petitioner to raise all such issues at the time of consideration of charge. With the aforesaid observation the revisional application stands disposed of.

Connected applications, if there be any, also stand disposed of.

Interim order, if there be any, stands vacated. Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.

All parties to this revisional application shall act on the server copy of this order downloaded from the official website of this Court.
