Re: CAN 2 of 2026 (extension of time for filing appeal). 1.

Learned counsel for the petitioners submits that by the judgment dated November 6, 2025, this Court had granted leave to the appellant to prefer an appropriate challenge before the statutorily designated appellate authority under the 1955 Act against the order under Section 14T(6) of the 1955 Act. The said time was further extended subsequently.

However, it is submitted that the concerned Block Land and Land Reforms Officer, English Bazar, Malda,, has observed in his communication dated December 19, 2025 that the office of the said authority is not involved in this case and, as such, it is pertinent to mention that the designation as present petitioners mentioned in their communication, that is, Revenue Officer, Malda,

Mokdompur, does not belong to the office of the said authority at present.

It is submitted that in view of the same, the appeal, for which leave was granted by this Court, could not be preferred.

However, after having disposed of the appeal on November 6, 2025, we, by our order dated December 9, 2025, had categorically clarified that the time granted for preferring the appropriate challenge would incorporate the time taken for obtaining certified copy and such time shall be added to the time already granted by us.

Accordingly, there is no scope of passing any order by this Court, which has now become functus officio. 6.

The petitioners will be at liberty to take out an appropriate challenge against the communication dated December 19, 2025, if aggrieved by the same.

CAN 2 of 2026 is disposed of accordingly without any order as to costs.
