Petitioner and the private respondents are fighting over a property. To that effect, Title Suit No.95 of 2024 is pending before the learned Civil Judge (Senior Division), Ghatal.

State has submitted a report. Report reflects that series of criminal cases being registered at the behest of the petitioner or the private respondents. Having considered that the plight of the petitioner is for residing peacefully at the residence as the petitioner presently is staying at rented accommodation, I direct that to establish the right to enter into the property, petitioner would approach the jurisdictional civil court for remedies available. So far

as the issue relating to peace and tranquility is concerned, police authorities would ensure that no untoward incident results because of the inimical relationship existing between the petitioner and the private respondents.

With the aforesaid observations, WPA 14797 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

Copy of the report be handed over to both the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
