Counsel for the petitioner submits that despite injunction passed by the learned 1st Civil Judge (Junior Division), Barasat in Title Suit No.199 of 2020, the private respondents are effecting construction and are violating such injunction.

Counsel for the private respondents submits that the injunction has been vacated and the application has been disposed of today. Counsel for the petitioner disputes the same.

In the above circumstances, this Court is of the view that the parties may approach the Civil Court for appropriate relief in the pending civil suit. In the event the injunction is still subsisting, the Court below shall direct the local police to enforce the order of injunction.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.
