It is the grievance of the petitioner that, although a tender was floated on July 1, 2024, by the Dharmada Gram Panchayat, Nadia, for the "Construction of an open-air stage in front of Maitri Club at Kanoda under Dharmada Gram Panchayat", no further steps have been taken pursuant to the said tender notice.
Learned counsel appearing for the State submitted that after floating the e-tender for execution of the said scheme, 43 inhabitants of Kandoa village lodged a complaint on 10.07.2024 with the Prodhan of the concerned Gram Panchayat, requesting that the scheme not be executed on the ground that the land proposed for the scheme was the individual property of the General Secretary of the petitioner.
Upon receipt of the said complaint dated 10.07.2024,
the concerned authority directed the petitioner to submit relevant land documents. The petitioner produced a proposal for long-term settlement issued by the Additional District Magistrate & DL&LRO, Nadia, which was forwarded to the Joint Secretary, Government of West Bengal, Land & Land Reforms Department, for approval in its favour. From the said proposal, it was evident that there existed a dispute regarding ownership of the land between the Government of West Bengal, Land & Land Reforms Department, and the petitioner.
On the basis of the aforesaid dispute, the Artha-OParikalpana Upa-Samiti, as well as the Tender Selection Committee of the Dharmada Gram Panchayat, decided unanimously in a meeting held on 12.07.2024 not to issue a work order for the said scheme to the concerned bidder until further decision of the Up-Samiti, in accordance with the "Rejection of Bid" provision under the terms and conditions of the Notice Inviting Tender vide Memo No. 305/DP/2024, dated 01.07.2024.
In view of the aforesaid circumstances, there is no justification to keep this writ petition pending. Accordingly, this writ petition is disposed of with a direction upon the Dharmada Gram Panchayat to take a final decision with regard to the tender process initiated by
the tender notice dated July 1, 2024, within a period of one month from the date of communication of this order. WPA 14826 of 2025 stands disposed of accordingly. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
