On November 4, 2025, when the matter was taken up for hearing, the learned advocate appearing for respondent no. 4 submitted that the construction in question had been raised with due permission from the concerned Panchayat Authority.

However, today it has been submitted by the learned advocate appearing for respondent no. 4 that no construction whatsoever has been raised by respondent no. 4 on the disputed land.

It appears that the representations made by the petitioners do not disclose any allegation of unauthorised construction by respondent no. 4. The pleadings made in paragraph 4 alleging unauthorised construction are also vague in nature.

A perusal of the report filed by the local police station does not indicate the existence of any unauthorised construction on the disputed plot of land.

From the materials placed, it appears that the dispute essentially concerns the use of the land as a playground, and as reflected in the police report, only goal posts are present on the said land, with no construction thereon.

Let the report filed by the Inspector of Police, Nabadwip Police Station, be kept on record.

In view of the aforesaid, WPA 14823 of 2025 is dismissed.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
