Mr. Nirmalya Kr. Das ...for the petitioner Ms. Rupsha Chakraborty ....for the State Learned Advocate appearing for the petitioner submits that in spite of informing the Officer-incharge, Rishra Police Station on or about 24.01.2022 regarding non-payment of part money by the private respondent, no steps have been taken by the police authorities.

As none appears on behalf of the State, Ms.

Rupsha Chakraborty, learned advocate who ordinarily appears for the State is directed to represent the State. Her appearance may be regularized by the concerned authorities.

In view of the nature of the accusations I am of the view that as the police authorities till date have not taken any step, petitioner would be at liberty to approach the jurisdictional Criminal Court by

invoking the provisions of Section 223 of BNS and or the appropriate Civil Court for recovery of the money. With the aforesaid observations WPA 14551 of 2023 is disposed of.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
