Banerjee) Mr. Soham Sanyal Mr. Roshan Pathak Ms. Tripti Sharma ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, Fast Track, 1st Court at Howrah to dispose of the Matrimonial Suit No. 270 of 2016 expeditiously.

Learned advocate appearing for the petitioner submits that the wife/opposite party herein filed an application under Section 24 of the Hindu Marriage Act and the learned trial judge passed an order directing the husband/petitioner to pay alimony at the rate of Rs. 20,000/- per month for the wife and Rs. 5,000/- for the accommodation. He further submits that the husband/petitioner is regularly paying the alimony and maintenance and has not defaulted in paying the same.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge.

From the order-sheets appended to this application this court finds that an application under Order 6 Rule 17 of the Civil Procedure Code filed on April 17, 2023 is fixed for hearing on December 15, 2025.

In the light of the submissions made by the learned advocate appearing for the petitioner, CO 2364 of 2025 stands disposed of by requesting the learned Additional District Judge, Fast Track, 1st Court at Howrah to take up the hearing of the application under Order 6 Rule 17 of the Civil Procedure Code, if the same is otherwise ready for hearing and to make an endeavour to disposed of as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the interlocutory application, the learned trial judge shall make an endeavour to dispose of the Matrimonial Suit No. 270 of 2016 as

expeditiously as possible without granting any unnecessary adjournment to either of the parties, if the husband/petitioner is not in default in making payment of alimony and maintenance.
