IA No.: CRAN 3 of 2023 is moved by the learned counsel for the petitioner stating that the dispute between the parties has been compounded and settled as the total cheque amount has been repaid by the petitioner. The present revision has been preferred against an order dated 19.03.2019 passed by the learned Additional District & Sessions Judge, 2nd Court, Hooghly Sadar in Criminal Appeal No.18 of 2007 wherein the court has been pleased to dismiss the appeal and thereby affirmed the judgement and order of conviction passed by the learned Judicial Magistrate, 4th Court, in CR 278 of 2013 and sentencing the petitioner to suffer SI for six months and to pay a fine of Rs.3,000/- in default to suffer SI for 7 days and also to pay compensation of Rs.1,50,000/-.

Learned counsel appearing for the opposite party no.2 has submitted in court that the petitioner has re-paid the total outstanding dues and the total amount has been repaid. The

petitioner now prays for withdrawing the sum of Rs.70,000/- deposited with the trial court as per the order passed by this High Court vide its order dated 22.11.2019.

Accordingly, considering the submission and the materials on record IA No.: CRAN 3 of 2023 is disposed of with the direction that the trial court shall permit the petitioner to withdraw the sum of Rs.70,000/- as deposited in compliance with the direction of the Hon'ble High Court on completion of all formalities and on proper verification subject to proper verification of the materials on record and on usual formalities.

The Criminal Revision being CRR 1831 of 2019 is accordingly disposed of.

All connected applications stand disposed of. Copy of this judgment be sent to the learned Trial Court forthwith for necessary compliance.
