Mr. Aniruddha Chatterjee, Mr. Saptarshi Kumar Mal ...for the private respondents The writ petitioner is aggrieved that her sons do not permit her to reside in her own premises. Admittedly, the ground floor of the said premises has been gifted to the daughter.

Counsel for the private respondents/sons submits that they have no objection to the petitioner coming and residing in the first floor of the said premises, and the said floor will be made available to her and her daughter, to take care of her.

The Officer-in-Charge, Manicktala Police Station has given instructions. It appears from the instructions dated February 14, 2022 that the police have visited the petitioner and have also enquired from the private respondents as to why they do not permit the mother to stay in the said premises.

This Court appreciates the proactive role of the Officer-in-Charge, Manicktala Police Station in the context of this case.

Since the sons have expressed that they have no objection to the mother staying along with her daughter in the first floor of the said premises, they are given month's time to make the ground, floor and other parts of this house habitable for themselves. The writ petitioner along with her daughter shall thereafter be entitled to reside in the first floor of the said premises. The Officer-in-Charge, Manicktala Police Station shall, if necessary, ensure and facilitate the same. The private respondents have also assured that they will take care of their mother.

With the aforesaid observations, the writ petition shall stand disposed of.

The report of the Officer-in-Charge, Manicktala Police Station, is taken on record.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
