The limited prayer of the petitioner is that the petitioner should be given some protection against an order passed by the District Magistrate, South 24 Parganas dated 16th February, 2022 but received by the petitioner on 5th July, 2022. The said order is for taking physical possession of the petitioner's residence. Learned counsel appearing for the petitioner submits that the petitioner could not approach DRT-3 challenging such order since DRT-3 is presently not functioning due to cease work.

The State is represented.

No one appears for the Asset Reconstruction Company despite being served on 11th July, 2022. WPA 15125 of 2022 is disposed of with an interim protection to the petitioner by restraining Asset Reconstruction Company from taking any coercive steps

until one week after the cease work before the DRT-3 is resolved.

This order is made subject to the petitioner's filing an application before the DRT-3 within five days from date.
