Mr. Triptimoy Talukder .....For the Petitioner Mr. Susovan Sengupta Ms. Saswati Chatterjee Mr. Sanatan Panja ......For the State The grievance of the petitioner pertains to nonpayment of gratuity dues in respect of services rendered by the petitioner's deceased husband.

It is submitted on behalf of the State that despite proceedings have been initiated under the Payments of Gratuity Act, the private respondent no. 5 being the Jessop & Company Limited has failed to make any payment.

It is further submitted on behalf of the State that proceedings have been initiated vis-a-vis the respondent no.5 under the Insolvency Code, 2013 and the proceedings are pending before the National Company Law Tribunal.

In view of the above, liberty is granted to the petitioner to file an appropriate proceeding in accordance with law in the pending insolvency proceedings before the National Company Law Tribunal, Kolkata.

Liberty is granted to the petitioner and the State to file a fresh petition if the circumstances so arise for the self same cause, in accordance with law.

With the above direction, WPA 15821 of 2024 stands disposed of without any order as to costs. (Ravi Krishan Kapur, J.)
