1. This application has been filed for recalling of the order dated December 4, 2025 passed by this Court dismissing the matter for default.

2. It appears that on the last two occasions prayer for adjournment was made on behalf of the petitioner and when the matter was called on none appear on behalf of the petitioner.

3. The learned Advocate representing the petitioner submits that on the learned Advocate was engaged in another matter before the coordinate bench, he could not appear on time and on miscommunication no one appeared when the matter was called.

4. The reason assigned prima facie appears to be satisfactory. This application stands allowed.

5. In view of the above, CO 2149 of 2024 be restored to its original file and number.

6. Let the matter appear in the monthly list of April, 2026 under the heading 'assigned matter'.

7. Accordingly, CAN 1 of 2025 stands disposed of. (Chaitali Chatterjee (Das), J.)
