08.07.2024 rc/ct.no.34 Item No.61 CRR No. 2434 of 2024 In the matter of : Kunj Behari Santhalia .......Petitioner Mr. Abhijit Kumar Adhya ...for the Petitioner On prayer of the petitioner the names of the 3rd opposite party, Binode Agarwal and 5th opposite party, Mohanlal Agarwal be expunged from the cause title of the application since they have expired during pendency of the application. Since the innocuous prayer of the petitioner is for expeditious disposal of the case being Complaint Case No. 43C of 2020 pending before the learned Judicial Magistrate, 5th Court, Howrah, the matter may be disposed of without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order of expeditious disposal of the matter. Learned counsel for the petitioner submits that the matter is pending since 2019 and the next date has been fixed on August 12, 2024 for evidence before charge.

In view of the above, the revisional application is disposed of directing the learned Judicial Magistrate, 5th Court, Howrah to dispose of the case being Complaint Case No. 43C of 2020 pending before him as expeditiously as possible without granting any unnecessary adjournment to either of the party, in accordance with law.

CRR No. 2434 of 2024 is disposed of accordingly. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
