The petitioner was apprehended on 7th January, 2020 and since then he is in custody.

Learned advocate for the petitioner submits that there has hardly been any progress of the case, although charge-sheet has already been filed.

Learned advocate for the State draws the attention of this Court to the report which reflects that on 21st December, 2021, date has been fixed by the learned trial court for framing of charge. Accordingly, the learned trial court is directed to either complete the process of consideration of charge on 21st December, 2021 or within a month thereafter and proceed with the trial of the case.

It has been informed that the prosecution has relied upon nine witnesses to prove its case and all witnesses either belong to the Government Department or the Police Department. In view of the aforesaid, learned Special Court is directed to fix schedule of three dates, once in every seventy five days and proceed with the trial of the case. No unnecessary adjournment should be granted to either of the parties and a schedule/date would be fixed or specified only when the learned public prosecutor conducting the case assures the court regarding the availability of the witnesses. All efforts must be taken to conclude the trial within a reasonable period of time.

With the aforesaid observations, CRR 1985 of 2021 is disposed of.
