The petitioner is aggrieved by order dated 7th June, 2024 passed by the Secretary, WBBPE rejecting an application for mutual transfer with the petitioner no. 2. The petitioner no. 1 has completed 5 years of service and seeks transfer now on the ground of distance. The petitioner no. 2 has not completed 5 years since her last transfer which was done in 2022. 2.

This Court notes that the petitioner no. 1 appears to be taking advantage of the medical grounds of the petitioner no. 2. Since the petitioner no. 1 has completed 5 years of service, he may apply for transfer on the grounds permitted under the applicable rules.

Insofar as the petitioner no. 2 is concerned, he may apply for transfer on medical grounds, if the same is substantiated. He may apply on other grounds upon completion of 5 years of service.

In that view of the matter, this Court finds no infirmity in the impugned order dated 7th June, 2024.

Hence, the writ petition fails and hereby dismissed.

There shall be no order as to costs.
