Having heard the Learned Advocate for the petitioner and on perusal of the instant application as well as the order passed by the Executive Magistrate, 1st Court at Howrah on 14th June, 2022 in M. P. Case No. 588/2022, being a proceeding under Section 144(2) of the Code of Criminal Procedure. The instant revision is disposed of directing the Executive Magistrate, 1st Court at Howrah to pass specific order directing the I.C., Domjur Police Station to file the Police report positively within 14 days from the date of communication of this order.

The Executive Magistrate, 1st Court at Howrah is also directed to dispose of M.P. Case No. 588/2022 within two weeks from the date of receipt of the Police report.

The Executive Magistrate, 1st Court at Howrah is further directed to consider that the vehicle under registration number WB 15D-8313 is being kept under the custody of some third parties and the registered owner of the vehicle is entitled to receive back possession of the said vehicle, if not wanted in any specific criminal case.
