Case No.486 of dated 16.12.2024 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act.

Dipankar Ghosh ... petitioner Mr. Snehansu Majumder ... for the petitioner Mr. Aniket Mitra Mr. Prakash Mishra ... for the State Learned counsel for the petitioner submits that apart from the statement of a co-accused, there is no other material present against the petitioner and the charge-sheet has been submitted.

Learned counsel for the State strongly opposes the prayer for anticipatory bail and relies on the case diary and the report, which is taken on record. It is further submitted that apart from the statement of a co-accused, there were phone call records between the petitioner and the arrested accused at the relevant time.

Considering the materials available in the case diary, including the CDR and SDR analysis of phone call records of the petitioner and the arrested accused and the restrictions contained under Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail, is thus, rejected.
