Affidavit-of-service filed by the petitioner be kept with the record.

Petitioner is aggrieved by the fact in spite of Alipore Police Station Case No.81 dated 17.06.2025 having been registered for investigation and the subject matter involves snatching away the property papers of the petitioner which was kept in a bag with the aid of miscreants associated with the private respondents, no steps have been taken by the concerned police station.

Records reflect that Alipore Police Station Case No.81/2025 was registered pursuant to direction passed by the learned CJM, Alipore in an application under Section 175(3) of the BNSS.

Learned advocate appearing for the private respondents disputes and denies the contentions and submits that since no affidavits have been called for, the accusations made in the writ petition are deemed not to have been admitted.

Having considered the case has already been registered in the month of June, 2025 and the same relates to property papers and the petitioner apprehends that there is every possibility of misusing the said document which would be to the detriment of the present petitioner, the Deputy Commissionerin-Charge of Alipore Police Station would monitor the case and would ensure that the police authorities would effectively conduct the investigation for tracing out the document which is the subject matter of the case so initiated at the behest of the present petitioner.

All efforts must be taken by the investigating officer of the case to unearth the truth. After the statutory period provided under Section 193 of the BNSS, the investigating officer would inform regarding the progress of the investigation of the present case to the present petitioner.

With the aforesaid observations, WPA 14830 of 2025 is disposed of.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
