Mr. Nitai Chandra Saha ...for the Petitioner The grievance of the petitioner is that a suit for specific performance of contract being Title Suit No. 180 of 2004 is pending before the learned Civil Judge (Senior Division) 7th Court at Alipore and the same was adjourned from time to time on frivolous grounds.

Record reveals that November 18, 2021 is fixed for peremptory hearing of the suit.

In view of the order sought and proposed to be passed there is no necessity of issuing any notice upon the opposite parties. However, the petitioner shall be obliged to forward a copy of this application as well as this order upon the opposite parties or their learned advocate in the Court below forthwith.

CO 1749 of 2021 accordingly stands disposed of with the hope and trust that the learned Civil Judge (Senior Division), 7th Court at Alipore shall dispose of Title Suit No. 180 of 2004 as expeditiously as possible without granting any unnecessary adjournment to either of the parties. There will be, however, no order as to costs.
