Affidavit of service filed in Court today is taken on record.

The petitioner aggrieved by the order dated 18th February, 2025 passed by the Senior Divisional Manager, Life Insurance Corporation of India (LICI) by opining that nothing is payable to the petitioner from LICI.

The petitioner submits that the reasoned order clearly records about payment of first premium by cash. The petitioner refers to the receipt showing payment of premium by cash and submits that as the first premium was accepted by the authority and receipt issued, the petitioner would be entitled to the refund.

Learned advocate appearing on behalf of LICI specifically denies receiving any payment from the petitioner.

It has been submitted that the petitioner was directed to produce the original receipt showing payment which the petitioner was unable to show.

It appears that the reasoned order clearly records that premium in respect of the subject policy was not paid.

There are disputed questions of facts in the instant writ petition which cannot be gone into or adjudicated in the instant writ petition.

In view of the above, the writ petition fails and is hereby dismissed.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
