The petitioner is aggrieved by the fact that in spite of the status quo order passed in Title Suit No. 314 of 2022 by the learned Civil Judge (Junior Division), Bidhannagar, the private respondents are proceeding with illegal construction.

In view of such submissions being made, the petitioner would be at liberty to approach the concerned civil court for police protection for implementing the order passed by the civil court. In case the civil court passes such an order, in that case, I direct that the Inspector-in-Charge, Lake Town Police Station would be bound to obey and respect and implement the order passed by the civil court.

With the aforesaid observations, the writ petition being WPA 14864 of 2023 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
