This case is pending since 2009. Almost 16 years have already passed.

The instant writ petition has been filed by the petitioner seeking direction upon the respondents, their agents, servants, subordinates, employees and/or assignees particularly the District Inspector of Schools (S.E.), Darjeeling to consider the representation made by the petitioner on 25.05.2009, annexure P-2 to the writ petition in accordance with law within a specified time.

The grievance of the writ petitioner in the said representation is for regularization of his service, who was working as an Assistant Teacher at Jaldhaka High School on ad hoc basis on and from 01.03.2000.

Considering the nature of prayers and long pendency of this case, this case is taken up the record for its disposal on the basis of material available on the record.

Upon perusal of the record, this Court finds that the petitioner was appointed on 01.03.2000 as an Assistant Teacher in language group "Bengali" by the D.G.H.C., Darjeeling. No affidavit-in-opposition has been filed till date as per the report submitted by the Office.

Upon overall consideration of the aforesaid facts, this Court directs the respondent no. 3 to consider his representation by giving an opportunity of hearing to the petitioner within eight weeks from the date of communication of a copy of this order and writ petition together with annexure thereof strictly in accordance with law, if not already disposed of.

The petitioner is directed to communicate this order to the concerned respondent for necessary information and compliance.

With the aforesaid observations, the writ petition being WPA 11427 of 2009 is disposed of. 10.

In view of disposal of this writ petition, connected pending application, if any, is also disposed of.

Interim order, if any, stands vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
