Smriti Das And ANR v. State Of West Bengal And ORS.
07.11.2022 Sl. No.5(DL) srm W.P.A. No. 15836 of 2021 Smriti Das & Anr.
Vs.
The State of West Bengal & Ors.
Mr. Jahar Lal De, Mr. Shamim ul Bari ....for the State-respondents.
Mr. Uttam Kumar Bhattacharya, Mr. Kaustav Mishra ...for the Respondent No.8.
None appears on behalf of the petitioners. No accommodation is prayed for.
Mr. De, learned Additional Government Pleader, and Mr.
Bhattacharya, learned Advocate for the respondent No.8, submit that the writ petition is not maintainable as the petitioners have prayed for correction of record of rights. It is submitted by them that this is the third round of litigation and the prayers in the writ petition cannot be decided by the authority. The only remedy, according to the learned Advocates, of the rspondents is that the petitioners are to either approach the civil court or the Land Reforms and Tenancy Tribunal.
However, as none appears on behalf of the petitioners, this Court is not entering into the merits of the writ petition.
The writ petition is dismissed for default.
There shall be no order as to costs.
