None appears for the State-respondents, despite notice.

The grievance of the petitioners is that the Section 18 proceeding pending before the learned Acquisition Collector, 24-Parganas (North) Annexure p-3 at page-15 to the writ petition is still pending.

In view of the above, the respondent no.2 is directed upon issuing a prior notice to the parties to the said Section 18 proceeding and after granting them an opportunity of hearing to dispose of the same by passing a reasoned order in accordance with law.

The entire exercise shall be carried out and completed by the respondent no.2 positively within a period of three months from the date of communication of this order.

It is made clear that this Court has not gone into the merit of the said Section 18 proceeding and the petitioners shall be at liberty to urge whatever points he wishes to urge by relying upon whatever records and documents he wishes to rely upon.

Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents. With the above observations and directions, this writ petition, WPA 15909 of 2024 stands disposed of, without any order as to costs.
