And In Re: - Dipak Kumar Singha Petitioner Mr. Y. J. Dastoor, Ld. ASG Mr. Phiroze Edulji Mr. Samrat Goswami .......For the CBI The order dated 10.09.2021 inadvertently referred to Mr. Arijit Ganguly, learned advocate appearing for the Union of India instead of Mr. Phiroze Edulji, learned advocate. This court on that date engaged Mr. Phiroze Edulji to submit a status/progress report of the case. Mr. Edulji has submitted a report of the Superintendent of Police, CBI/ACB/Kolkata which is kept with the record.

The report reflects that out of 82 persons proposed to be examined by the prosecution, 23 witnesses have already been examined. The subject matter of challenge is the order dated 31.03.2012 passed by the learned Special Judge, CBI Court, Alipore which was in respect of the order of framing of charge. Having regard to the progress of the trial, I am of the view that no interference can be made at this belated stage. Accordingly, CRR 2142 of 2012 is dismissed.

Pending applications, if any, consequentially stand disposed of.

Interim order, if any, is hereby vacated.
