Dipak Kumar Singha v. C.B.I.
CRR 2143 of 2012 g.b.
28.09.2021 Court No.34 In Re: - An application under Sections 397, 401 and 482 of the Code of Criminal Procedure read with Article 227 of the Constitution of India;
And In Re: - Dipak Kumar Singha Petitioner Mr. Y. J. Dastoor, Ld. ASG Mr. Phiroze Edulji Mr. Samrat Goswami .......For the CBI The report submitted by the learned advocate for the CBI is kept with the record.
Mr. Edulji, learned advocate has submitted a report of the Superintendent of Police, CBI/ACB/Kolkata pursuant to the order dated 10.09.2021 passed by this court.
The revisional application was preferred challenging the order dated 31.03.2012 passed by the learned Special Judge, CBI Court at Alipore wherein the learned Special Court was pleased to frame charge against the present petitioner. The report so submitted reflects that out of 50 persons proposed to be examined by the prosecution, 25 witnesses have already been examined.
Having regard to the progress of the trial, I am of the view that no interference can be made at this belated stage. Accordingly, CRR 2143 of 2012 is dismissed.
Pending applications, if any, consequentially stand disposed of.
Interim order, if any, is hereby vacated.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. - (Tirthankar Ghosh, J.)
