Respondent no.4 The petitioner submits that T.S. 04 of 2014 is pending where status quo order was passed, the same was modified subsequently by the learned Civil Judge (Sr. Divn.), Diamond Harbour. Consequent to which, the petitioner intends to cultivate on the land, but, was resisted by the private respondents as well as the police authorities.

Learned advocate for the private respondents is present and submits that the accusations made in the writ petition are denied and disputed and, since,

affidavits have not been called for, other allegations contained in the writ petition are deemed not to have been admitted.

State has submitted a report which reflects that the police authorities are well aware regarding the dispute existing relating to cultivation of land between the petitioner and the private respondents.

Since the police authorities have drawn up proceedings under the relevant provisions of 126 of the BNSS, they would oversee that no breach of peace and/or tranquility takes place as also no untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 14862 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with

the record. Copies of the report be handed over to both the parties.
