Ejaz Akhtar ....for the State Learned counsel appearing on behalf of the petitioners submits that as per FIR it was one Mahidur Rahaman who gave the particular blow on the head of the victim.

Learned counsel appearing on behalf of the State relies on the case diary and submits that according to the statement of the injured victim as well as the independent eye-witnesses, all the accused including the present petitioners caused the injuries. It appears from the city scan report that there was fracture involving the left zygomatic arch, greater wing of sphenoid, mediolateral wall of left orbit. The injury report says that the injury required nine stitches to be given.

Considering the incriminating materials available in the case diary including the statement of the victim, the independent eyewitnesses and the injury report, I do not consider this to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
